Welcome to Brand U! These Terms and Conditions ("Terms") govern your use of the Resilient Career Series course from Brand U, which is hosted on the Thinkific website. By accessing or using our course, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use the course.
1. Acceptance of Terms
By purchasing or enrolling in this course, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. You also agree to be bound by the terms of service of the host platform, Thinkific.
2. Limited License for Personal Use
All course content, materials, and resources provided within the Resilient Career Series are for your personal, non-commercial use only. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the course content for your own individual educational purposes. This license does not permit you to use the course for any commercial, professional, group training, or business-related purposes, or to train or coach others, without the explicit written consent of Brand U.
3. Intellectual Property (IP)
All content, materials, and resources provided within the Resilient Career Series course, including but not limited to text, videos, audio, documents, and any other proprietary information, are the exclusive intellectual property of Brand U. This content is protected by copyright, trademark, and other intellectual property laws.
You are expressly forbidden from reproducing, distributing, modifying, creating derivative works of, publicly displaying, or sharing any part of the course materials with any third party, whether for free or for a fee. Unauthorized sharing, including but not limited to providing your login credentials to others or distributing course files, is a direct violation of copyright law and these terms. Legal action, including seeking damages and injunctive relief, will be pursued for any breach of this clause.
4. Community Guidelines and User Conduct
Brand U may provide access to community forums, discussion boards, or other interactive areas on its website or the Resilient Career Series platform. Your access to these communities is a privilege, not a right.
Expected Behavior: You agree to act respectfully and professionally toward all other participants. Harassment, threats, abusive language, or any behavior that violates the legal rights of others will not be tolerated and may result in the immediate termination of your access to the course and community.
Disclaimer of Responsibility: Brand U and its affiliates, employees, or agents are not responsible for the content, opinions, advice, or behavior of any other users in these communities. The views and opinions expressed by other users are their own and do not necessarily reflect the views of Brand U. You use these community forums at your own risk and are solely responsible for any content you post.
5. Account Security
You are responsible for maintaining the confidentiality of your account login information and password. You agree to be fully responsible for all activities that occur under your account, whether you authorized them or not. You must notify Brand U immediately of any unauthorized use of your account.

TO THE FULLEST EXTENT PERMITTED BY LAW, BRAND U DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
You understand and agree that you are solely responsible for your own actions and decisions. By enrolling in this course, you explicitly waive any right to hold Brand U, its founder, its owner its employees or its affiliates liable for any failure to achieve a desired outcome.
7. Indemnification
You agree to indemnify, defend, and hold harmless Brand U and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable legal fees and costs, arising out of or in any way connected with your access to or use of the course, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.
8. Refund Policy
All sales are final. We do not offer any refunds for this course under any circumstances. By purchasing this course, you agree that you are making a final, non-refundable purchase. This policy is in place because the course content is a digital product that is immediately accessible upon purchase.
9. Limitation of Liability
To the fullest extent permitted by law, in no event will Brand U or the Thinkific platform be liable for any indirect, incidental, special, or consequential damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the course; (b) any conduct or content of any third party; or (c) any unauthorized access, use, or alteration of your transmissions or content. Our total liability to you for any damages will not exceed the amount you paid for the course.
10. Governing Law, Dispute Resolution, and Arbitration
These Terms shall be governed by the laws of Ontario, Canada, without regard to its conflict of law provisions. Any legal action or proceeding related to this course or these terms shall be brought exclusively in the courts of Ontario, Canada.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by final and binding arbitration administered by a mutually agreed-upon arbitration service in Ontario, Canada, and conducted in accordance with the rules of said service. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
11. Termination of Access
We reserve the right to terminate or suspend your access to the course immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the course will immediately cease.
